PATRIOT Act II?

The Center for Public Integrity posted a draft of the Domestic Security and Enhancement Act (aka PATRIOT Act II). The bill has not yet been introduced into Congress, but gives a good indication of the direction that the drafters of the document would like to move.

Provisions of the document allow government to eliminate more checks and balances on law enforcement, while at the same time diminishing civil liberties.

These provisions include:

  • Non-citizens could be deported even if they have not committed any immigration violations.
  • The Freedom of Information Act would be amended so that the public would be restricted from obtaining the identification of detainees
  • The U.S. Attorney General could authorize wiretaps on individuals for 15 days with no court order by certain actions by Congress or the President.
  • Consent decrees that prohibit police from spying could be eliminated.
  • DNA samples could be collected from anyone suspected of being a terrorist even if that person had committed no crime.
